Terms and Conditions

Rental Contract: 

1. RENTAL PERIOD & LATE FEES

Weekend Rental: The rental begins at the time of pickup and ends upon return.

The "30-Minute Rule": Renter agrees to text 813-954-0750 at least 30 minutes prior to both pickup and return to coordinate timing.

Late Fees: Equipment not returned by the agreed time will incur an initial $25 fee, plus $50 per day (or the full rental cost, whichever is greater).

Non-Return: If not returned within three (3) days, Renter will be charged the full replacement cost plus a 15% sourcing fee. Per Florida Statute 812.155, failure to return rental equipment within three (3) days of the agreed date will be treated as theft and charged at full replacement cost.

2. EQUIPMENT CONDITION & USE

Inspection: Renter acknowledges Equipment was inspected and deemed in good working order at receipt. Any defects must be reported immediately.

Prohibited Uses: Equipment must be used for its intended purpose only. Renter may not relocate, sublease, or loan Equipment to third parties or secondary addresses without prior written consent.

Supervision: Renter agrees that all Equipment used in the presence of minors will be supervised by a responsible adult at all times.

3. SAFETY, LIABILITY & ASSUMPTION OF RISK

Assumption of Risk: Renter assumes all risk and responsibility for the setup, operation, and supervision of the Equipment.

Safety Equipment: Great Gatherings Rental does NOT provide safety or eye protection. Renter agrees to provide their own safety equipment and assumes all risks of injury.

Release of Liability: The Company, its owners, and agents shall not be held liable for any injuries, damages, or losses arising from the use or misuse of the Equipment. Company liability shall not exceed the total rental fees paid.

Indemnification: Renter agrees to defend and hold harmless the Company from any claims, losses, or legal expenses resulting from the use of the Equipment.

4. DAMAGE, LOSS, & CLEANING

Condition on Return: Equipment must be returned clean and free of debris. A cleaning fee of $25- $50 (as stated in the product description) applies to items returned in unsanitary condition.

Damage/Loss: Renter authorizes the Company to charge the credit card on file for the full cost of repair or replacement for any damage, loss, or theft occurring during the rental period.

5. PAYMENT, DEPOSIT, & CANCELLATION

Payment: All fees must be paid in full prior to pickup/delivery.  The Booking / Security Deposit will be applied toward any damages, missing items, or late returns. 

Booking / Security Deposit:  A Booking / Security Deposit is required for all orders. This deposit secures your date and is non-refundable upon cancellation. Once the rental begins, it serves as a security hold for the equipment. Deposit amounts vary by item value (e.g., $20 for standard items, $125 for electronics packages).

The deposit will be forfeited if:

1. The rental is cancelled by the customer.
2. Items are returned damaged, excessively dirty, or late.
3. Items are missing from the order

 Refund of Booking / Security Deposit: Deposits are processed for a full refund within 1-3 business days following the return of all equipment in its original, clean, and working condition. Refunds are issued back to the original payment method.

We understand that wear and tear happens; however, to keep our rental rates affordable for everyone, deductions may be applied for:

• Missing or Damaged Items: Charged at the current market replacement cost.
• Professional Cleaning: If items are returned with stains, mud, or debris requiring more than a standard wipe-down.
• Late Returns: Calculated based on the daily rental rate of the items.

A detailed 'Condition Report' and itemized receipt for any replacement fees or repair costs will be provided before any deductions are finalized.

Cancellation Policy: Any rental fees paid are non-refundable for cancellations made within 14 days of the scheduled rental date.

6. LEGAL TERMS

Force Majeure: Company is not liable for delays or cancellations caused by acts of God, extreme weather, or government restrictions.

Governing Law: This Agreement is governed by the laws of the State of Florida. The prevailing party in any legal dispute shall be entitled to recover reasonable attorney fees and court costs.

Severability: If any provision is found unenforceable, the remaining terms remains in full force.

PROHIBITED USES Equipment shall not be used for unlawful activities or in unsafe conditions (extreme weather, etc.). Renter may not relocate, sublease, or loan equipment to third parties or to an address other than the agreed-upon event location.
